Video Surveillance Policy

Sperry (individually or collectively referred to as “we”, “us” or “Sperry”) strive to be transparent about the information we collect about you, and how we use and share it. The purpose of this privacy notice is to explain how we conduct video surveillance in our stores, offices, warehouses and other property owned or leased by us (collectively, “Premises”). Wherever we have video surveillance, there are signs to inform you of the operation. This Privacy Notice applies to all individuals including customers, employees, contractors, and visitors to our Premises.

What information do we collect and how?

We will process your image captured by video surveillance technology. If an investigation or a claim is established, other information relevant to the incident will also be processed together with such video footage, such as details in an incident report or insurance claim. 

Images are captured using video surveillance technology placed near entrances and exits to our Premises, as well as in other appropriate locations throughout the Premises. We do not place cameras in areas with heighted expectations of privacy, such as within washrooms or changing rooms. For added transparency, in non-public areas such as the back store, cameras are positioned solely to monitor high-security zones, specifically safes and back entrances. 

The video surveillance technology in use is not equipped with facial recognition technology. The cameras will be clearly marked and visible. Depending on location, cameras are either motion activated or monitored live 24 hours a day, seven days a week, and in either case video images are recorded 

How do we use your information?

This surveillance helps us maintain a secure environment and may involve the collection of personal data. Such data may be used for the following purposes: 

  • To monitor for, protect against, and deter theft, vandalism, security incidents and other malicious or criminal activities.
  • To investigate complaints, accidents, crimes and acts of misconduct, such as vandalism, theft, violence, or other breaches of law, contract, or company policies. Such investigations may be triggered by the occurrence of an incident, serious suspicion of an incident, whistleblowing, grievance reporting or complaints made through other channels.
  • To establish, exercise and/or defend our rights as well as current and/or future, legal claims. For example, if an incident occurs, video recordings may be used to identify suspects, provide evidence of wrongdoing, and for criminal prosecution.
  • To improve operations, such as traffic pattern analysis. 

Information obtained from video monitoring may also be used for disciplinary purposes if an investigation reveals employee misconduct, including theft, violence, dishonesty, policy infractions, safety infractions or damaging company property. 

How do we share your information?

 Recorded material is accessible only to security personnel, human resources (where needed for employment purposes), and management employees who need the data to accomplish the intended processing purposes. For more information, please see the Sperry Privacy Policy. 

Where applicable, we may share video recordings with security companies and legal advisors to handle security issues and administration, such as organized retail crime investigations. Video recordings may also be disclosed to authorities, including, for example, the police and other law enforcement officials, or the local authority responsible for emergency service  

How long is the data stored for?

Video recordings are kept up to 90 days after they were recorded, unless an incident occurs or we are required by law or at the request of an authority to retain this data for a longer period. Given the large amount of data generated by CCTV systems, we may store video footage using a cloud computing system. We will take all reasonable steps to ensure that any cloud service provider maintains the security of our information, in accordance with industry standards. We may engage data processors to process data on our behalf. We will ensure reasonable contractual safeguards are in place to protect the security and integrity of the data. Footage may be extracted in cases of investigation and may be retained and used until the investigation is terminated. Personal data used in legal disputes or for the establishment, exercise, or defense of legal claims will be saved for as long as needed for such purposes. 

 

Where is the data processed?

Video images are processed and stored in Canada and the United States. If you are in Quebec, your information may be communicated outside Quebec. Please note that information transferred or stored outside Canada may be accessible to courts, law enforcement and national authorities in other countries. 

What are your rights regarding your information?

Depending on the applicable law in the jurisdiction where you are located, you may have certain rights that allow you to obtain information about and control over your own personal data You will find contact details for the relevant Aldo company to assert your rights under the “How Do You Exercise Your Rights” section.

How do you exercise your rights?

 Sperry is responsible for the processing of personal data that is carried out in connection with our video surveillance technology.

How will you know that this Privacy Notice has changed?

From time to time, we may update this Privacy Notice. Subject to applicable laws, we will notify you of these changes. Updates will be effective when we post the revised Privacy Notice. This Privacy Policy was last updated as of the effective date listed at the bottom of this Privacy Notice.
